Welcome to Wylsha. These Terms of Service ("Terms") govern your use of our website located at https://bhghhf-w0.myshopify.com (the "Site") and the purchase of products from Wylsha. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.
1. Contract Formation
By accessing the Site, creating an account, or purchasing products, you agree to these Terms, forming a legally binding contract with MASHAE WILLIAMS LLC, a limited liability company (LLC) formed in California.
2. Governing Law and Venue
These Terms and any disputes arising from your use of the Site or purchase of products shall be governed by the laws of the State of California, without regard to its conflict of law principles. Any legal proceedings shall be brought exclusively in the courts located in California.
3. Binding Individual Arbitration Clause
Any dispute or claim arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in Baytown, California, before a single arbitrator. You have the right to opt-out of this arbitration clause by sending a written notice to wylsha@outlook.com within 30 days of accepting these Terms.
4. Class Action Waiver
You agree to resolve any disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration. Notwithstanding the arbitration clause, nothing in these Terms shall waive any consumer's right to seek public injunctive relief under California law (per McGill v. Citibank, 2 Cal. 5th 945 (2017)).
5. Limitation of Liability
To the fullest extent permitted by law, Wylsha shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Site or purchase of products. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.
6. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of Wylsha or its content suppliers and is protected by United States and international copyright laws. You may not use, reproduce, or distribute any content from the Site without our express written permission.
7. User Obligations
You agree not to engage in any fraudulent activities, use the Site for any unlawful purposes, scrape or collect data from the Site, or resell products purchased from the Site without authorization. Violation of these obligations may result in termination of your account.
8. Disclaimer of Warranties
All products and services provided by Wylsha are offered "AS IS" and "AS AVAILABLE," without any warranties of any kind, either express or implied, except as required by the Magnuson-Moss Warranty Act. Before initiating arbitration, you agree to attempt to resolve any dispute informally by contacting us at wylsha@outlook.com. We will attempt to resolve the dispute informally within 30 days.
10. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
11. Modifications of the Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Site. Your continued use of the Site following the posting of changes constitutes your acceptance of such changes. Please review these Terms periodically for updates.
12. Termination
We reserve the right to terminate your access to the Site and your account for any violation of these Terms or for any other reason at our sole discretion.
